Understanding Overtime

1. What Qualifies as Overtime?

The Fair Labor Standard Act defines overtime as hours worked in excess of 40 in a work week at UF. The work week spans from 12:00 am Friday morning to 11:59 pm on the following Thursday.

  • If you are a non-exempt TEAMS employee:
    • Earn one and one-half hours of overtime compensation for each hour worked beyond 40.
    • Overtime does not include paid time off.

2. Overtime Compensation Process

The Wage & Hour Law requires that all non-exempt TEAMS employees be compensated for overtime.

  • Compensation can be in the form of paid time off at one and one-half hours for each overtime hour.
  • After accumulating 120 hours of overtime compensatory leave, additional overtime is paid in cash at time and one-half.
  • OPS hourly employees must be paid overtime at one and one-half times their regular rate of pay in cash since they do not accrue leave.
  • Exempt employees are not entitled to overtime pay as per the Wage & Hour Law.
  • TEAMS exempt employees do not qualify for “regular compensation” for overtime hours worked.

3. Travel Status and Overtime

  • Travel for University work is considered time worked.
  • Non-exempt employees in official travel status might exceed 40 hours per week due to travel time.
  • In such cases, employees are in overtime status and must be compensated following standard overtime compensation policies.
